Terms of Use
These Terms of Use govern your access to PayFresco websites, application pages, CRM access pages, calculators, scheduling links, Telegram handoff paths, email links, and related online materials.
By using PayFresco online properties, submitting an inquiry, starting an application, uploading documents, scheduling a call, messaging the PayFresco team, or accessing a PayFresco CRM page, you agree to these Terms. If you are using PayFresco for a company, you represent that you are authorized to act for that company.
1. What PayFresco Provides
PayFresco provides business-facing information, merchant intake, CRM access pages, payment-option positioning, application support, follow-up workflows, and related communications for eCommerce merchants. PayFresco may route merchant application information into operational systems, including RetryHub-managed intake and CRM workflows, so the team can review the inquiry and coordinate next steps.
PayFresco website content is informational. The website is not a bank, card network, acquiring bank, payment processor, law firm, accounting firm, underwriting authority, or government agency. Any merchant service, payment account, gateway, CRM workspace, settlement schedule, reserve, pricing term, document requirement, or processing capability may be subject to separate review and separate agreements.
2. Separate Agreements Control Approved Services
If you proceed with a payment provider, CRM account, merchant service, processor, gateway, referral partner, or other third-party service, that service may have its own application, underwriting process, contract, privacy terms, pricing, risk controls, operating rules, and prohibited-business rules. Those terms are separate from these website Terms.
If these website Terms conflict with a signed agreement that directly applies to a specific PayFresco service, payment provider relationship, or CRM arrangement, the signed agreement controls for that specific service.
3. Eligibility and Business Use
PayFresco is intended for business use. You must be at least 18 years old and legally able to enter into agreements. If you submit information for a business, you confirm that you have authority to provide that information, request review, and communicate with PayFresco on behalf of the business.
You are responsible for ensuring that your products, services, sales methods, claims, refund policies, fulfillment practices, marketing, customer communications, licensing, tax registrations, and payment activity comply with applicable laws, card-network rules, provider rules, platform terms, and any industry-specific requirements.
4. Application Information and Documents
You agree that information you submit to PayFresco will be accurate, current, complete, and not misleading. Application information may include owner details, business details, contact information, website URLs, product descriptions, processing history, bank-account details, tax identifiers, identity documents, proof-of-address documents, business registration documents, processing statements, and other review materials requested for your category.
You authorize PayFresco and its operational service providers to use submitted information to review your inquiry, prepare application materials, coordinate document requests, communicate with you, route information into the PayFresco or RetryHub CRM workflow, and share relevant application details with payment, CRM, underwriting, compliance, support, or referral partners when needed to evaluate or support your request.
Do not submit payment-card numbers, customer card data, account passwords, private keys, unrelated medical records, or other information that PayFresco has not requested. If you are unsure whether a document should be submitted, contact PayFresco first.
5. No Approval, Pricing, or Revenue Guarantee
PayFresco may describe access to multiple payment options, CRM functionality, application paths, industry coverage, estimated savings, approval-readiness steps, or operational improvements. These descriptions do not guarantee that any merchant will be approved, receive a particular processor, obtain a specific gateway, qualify for any rate, avoid reserves, receive a specific deposit speed, reduce chargebacks, increase revenue, retain customers, or receive continuous service.
Payment-provider availability and terms may depend on business model, owner information, products sold, claims made, risk category, transaction history, refund policy, chargeback profile, fulfillment method, country coverage, documentation, underwriting standards, provider capacity, laws, card-network rules, and other factors outside PayFresco's control.
6. Calculators, Estimates, and Website Content
PayFresco calculators, ROI estimates, examples, articles, checklists, dashboards, numbers, approval references, and comparisons are directional business information. They are not financial, legal, tax, accounting, compliance, underwriting, or investment advice.
You should evaluate any estimate using your own data and professional advisors. PayFresco may update, remove, or revise content at any time.
7. Communications, Telegram, Email, and Scheduling
When you submit a form, email PayFresco, schedule a call, or message through Telegram, you consent to receive business communications about your inquiry, application, document requests, CRM access, payment options, support needs, and related PayFresco services.
Telegram, email, calendar tools, CRM pages, and third-party links may be operated by third parties. PayFresco is not responsible for the availability, privacy practices, security practices, content, or terms of those third-party services. Avoid sending passwords, cardholder data, or unnecessary sensitive information through open chat or email channels.
8. Prohibited Uses
You agree not to use PayFresco online properties to:
- submit false, fraudulent, stolen, misleading, or unauthorized information;
- impersonate another person or business;
- seek services for unlawful products, deceptive sales practices, sanctions violations, money laundering, unauthorized financial services, or activity prohibited by applicable provider rules;
- interfere with the website, CRM access pages, intake flow, APIs, security controls, or supporting infrastructure;
- upload malware, harmful files, automated scraping traffic, spam, or abusive content;
- reverse engineer, copy, resell, or misuse PayFresco content or systems except as permitted by law;
- attempt unauthorized access to any PayFresco, RetryHub, provider, or customer account.
9. Intellectual Property
PayFresco names, logos, pages, copy, page layouts, graphics, calculators, workflows, and other website materials are owned by PayFresco or its licensors and are protected by applicable intellectual-property laws. You may view and use the website for legitimate business evaluation and application purposes. You may not copy, publish, sublicense, scrape, or commercialize PayFresco materials without permission.
10. Privacy
PayFresco's handling of personal information is described in the Privacy Policy. By using PayFresco online properties, you acknowledge that PayFresco may collect, use, retain, and share information as described there.
11. Availability and Changes
PayFresco may change, suspend, or discontinue website pages, calculators, application flows, CRM access pages, contact channels, scheduling links, Telegram flows, feature descriptions, or service availability at any time. PayFresco does not guarantee uninterrupted access, error-free operation, or compatibility with every browser, device, integration, payment provider, or merchant category.
12. Disclaimers and Limitation of Liability
PayFresco online properties are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PayFresco disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.
To the fullest extent permitted by law, PayFresco will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost revenue, lost data, lost goodwill, business interruption, declined applications, provider denials, processor changes, reserves, account holds, chargebacks, refunds, settlement delays, or third-party service failures arising from or related to your use of PayFresco online properties.
13. Indemnification
You agree to defend, indemnify, and hold PayFresco harmless from claims, losses, liabilities, damages, costs, and expenses arising from your submitted information, products or services, website claims, customer practices, violation of these Terms, violation of law, infringement of third-party rights, or misuse of PayFresco online properties.
14. Governing Law and Disputes
These Terms are governed by applicable United States law and any mandatory law that cannot be waived. Unless a separate written agreement says otherwise, disputes will be handled in a court with proper jurisdiction over the parties and the dispute.
15. Updates to These Terms
PayFresco may update these Terms as the website, application process, CRM workflow, payment-option coverage, or legal requirements change. The effective date above shows when this page was last updated. Continued use after an update means you accept the updated Terms.
